Ekvita má filosofický základ v antickém Řecku, ovlivnila římské právní myšlení a je součástí justiční praxe českých soudů.

Creditor as an Influential Person (or: Influence Is Not the Same as Be Under Influence)

The article, published in the Czech and German languages, is focused on general issues relating to the creditor as the potentially influential person, to the legislative aspects of the provision pertaining to the conduct of an influential person in the Civil Code and in the Company Act, and to the status of the creditor in a company. Článek je publikovaný v češtině a němčině. Autor se zaměřuje na obecnější otázky týkající se věřitele coby možné vlivné osoby, na právní úpravu pravidla pro chování vlivné osoby v občanském zákoníku a v zákonu o obchodních korporacích, a na postavení věřitele v obchodní korporaci.

Excessive Regulation, or Chaos?

The article deals with two questions: Is there overproduction of law in the Czech legal order? Is the EU the main cause of the overproduction of the modifications in the Czech Republic? Data analysis of the legal corpus shows that answers to both questions are negative. Příspěvek si klade dvě základní otázky. Lze tvrdit, že český právní řád trpí nadměrnou regulací? Je nadprodukce novelizací způsobena vlivem legislativy EU? Na základě analýzy dat odpovídáme na obě otázky záporně.

Článek se zabývá otázkou státních symbolů v novém maďarském Základním zákoně z roku 2011. Tento dokument obohacuje ústavní pořádek několika novými prvky (např. definice státních svátků, symbolická role prezidenta, specifikace měny v ústavě).
