This article deals with the problem of collection data on legislature and legislative systém namely the Czech legislative systém and using them for analytical scientific purposes. Collecting of such data presupposes of course creating of special databases and software. Článek se zabývá problematikou sběru dat v legislatuře a v legislativě, zejména v legislativním systému České republiky, a jejich využitím pro analyticko-vědecké účely. Sběr takových dat samozřejmě předpokládá vytvoření speciálních databází a softwaru.

The Impact of EU law on the status of athletes

The article describes post-Bosman legal environment of athletes and picks some examples which demonstrate diversity in regulation of sport sector with focus on labor law relations. Firstly it refutes the Czech myth that the ratio of Bosman case imposes on member states a duty to legislate that all athletes are employees. Then the article covers differences concerning post-Bosman requirements for international transfers and transfers within one state etc. Influence of Fixed-term directive on sports relations is described and its effects in connection with some concrete cases coming from couple of national jurisdictions, which surprisingly depart from recognition of specificity of sports sector, referring to general labor laws. Therefore the article considers that also the social dialog might be a solution for sports sector rather than to rely on case by case basis of its relationship to law in front of the courts. Article also in its conclusion admits that it seems to be impossible to harmonize European labor law to sport because it is indeed special and new article in Lisbon Treaty does not solve much in this respect as well. Therefore the main message of the article is its presentation of varieties of European labor and sports law. Článek popisuje právní prostředí sportovců po rozsudku Bosman a vybírá některé příklady demonstrující roztříštěnost regulace sportu ve světle pracovního práva. Článek nejprve vyvrací mýtus, podle kterého by měl být každý profesionální sportovec na základě rozsudku Bosman zaměstnancem. Dále se článek zabývá rozdílnými podmínkami pro přestupy sportovců do zahraničí a uvnitř členského státu EU, které jsou aplikované opět v období po vydání rozsudku Bosman. Vliv Směrnice Rady č. 1999/70/ES o pracovních úvazcích na dobu určitou je demonstrován na judikátech z různých jurisdikcí členských států EU a překvapivě v těchto případech dochází k odklonu uznávání specifik sportu ve prospěch norem pracovního práva. Naopak judikatura Soudního dvora EU specifika sportu respektovala. Řešením by mohl být sociáloní dialog a touto otázkou se článek též zabývá. Nakonec článek uzavírá problematiku konstatováním, že je nemožné harmonizovat Evropské pracovní právo v specifickém odvětví sportu a ani Lisabonská smlouva v tomto ohledu nedává žádný recept. Proto je hlavním obsahem článku prezentace nejednotnosti Evropského pracovního práva a sportu v EU.

Animal Right : a Philosophical Perspective

The issue of animal rights is an essential part of practical ethics. Most authors argue that speciesism (defined as a prejudice of attitude of bias toward the interests of members of one’s own species) opposes liberationism. The overall aim of this contribution is to show that this conviction is wrong. In the first part, some remarks concerning current debate on animal rights are made, with special attention to Peter Singer. The second part of the paper is devoted in detail to clarifying the role of speciesism in opposing liberationism. It concludes by noting that only a highly specific form of speciesism is, in fact, in opposition to liberationism. We can hold speciesism and engage in animal liberationism based on ascription of some morally relevant properties (sentience) to animals. Problém práv zvířat tvoří důležitou součást praktické etiky. Velká část autorů tvrdí, že speciesismus (definovaný jako předsudečné upřednostňování zájmů vlastního druhu) je v opozici vůči liberacionismu. Hlavním cílem tohoto příspěvku je ukázat, že toto přesvědčení je chybné. V první části se stručně zmiňuje současná diskuse o právech zvířat se zaměřením na Petera Singera. V druhé části se podrobně diskutuje role speciesismu jako možné opozice vůči liberacionismu. Článek uzavírá, že pouze velmi specifická forma speciesismu se staví proti liberacionismu. Můžeme zastávat speciesismus a současně se podílet na hnutí za osvobození zvířat založeném na připsání určitých morálně relevantních vlastností zvířatům.
