Individuality of the Early Human Embryo

In his contribution, the author, by means of philosophical argumentation, arrived at the conclusion that a human embryo is in all the stages of its development an individual member of humankind. However, this conclusion is just the first step to solution of the issue of moral evaluation of human embryonic stem cell research. Autor ve svém příspěvku pomocí filosofické argumentace dochází k závěru, že lidské embryo je ve všech fázích svého vývoje individuálním příslušníkem lidského druhu. Tento závěr je však pouze prvním krokem k řešení problému morálního hodnocení výzkumu lidských embryonálních kmenových buněk.

Human embryonic stem cell research causes huge controversies within biomedical research. The article pays attention to basic approaches to emryonic stem cell research in legislation of the Czech Republic and other states. V rámci biomedicínského výzkumu vyvolává ostré kontroverze vědecký výzkum prováděný na lidských embryonálních kmenových buňkách. Článek se zabývá základními přístupy k výzkumu na embryonálních kmenových buňkách v legislativě v ČR a dalších státech.

Being a chief executive officer does not, of inself, make that person an employee of the company. On the contrary, general powers of management are, in accordance with stabile Czech Supreme court' case law, the main reason why a chief executive officer is not an employee. But the legislature has changed the Commercial Code. Článek pojednává o možnosti statutárního orgánu či jeho člena vykonávat obchodní vedení společnosti v pracovněprávním vztahu jako zaměstnanec. Vedle analýzy právní úpravy dochází autor též k četným návrhům de lege ferenda.

Production and Modifications of the Primary Legislation in the Countries V4 and the Austria

The author deals with a quantitative description of the production and modifications of the primary legislation in the countries V4 and its comparison with the Austria. The methodology is based on the analyze of data from official information systems of the countries above mentioned. It seems, that the countries V4 move in a different direction then the Austria. We can observe the extreme increase in the production of modifications in the countries V4 after 1990. The situation described on the level of simple graphs shows very dangerous trends in the countries V4, which head for the decline of legal orders in these countries. Autor se zabývá zkoumáním kvantitativní produkce novelizací zákonů v zemích V4 v porovnání s Rakouskem. Metodologie tohoto zkoumání je založena na analýze dat z oficiálních informačních systémů výše zmíněných zemí. Zdá se, že země V4 se ubírají odlišným směrem než Rakousko. V zemích V4 můžeme totiž pozorovat obrovský nárůst počtu novelizací po roce 1990. Tento vývoj je zachycen v jednoduchých grafech a představuje pro legislativu těchto zemí velké riziko do budoucna.

We may document cases from both the past and the present when despite of subsidiary applicability of the Civil Code (Civil Law) it was not possible to address the needs of economic life satisfactorily. In this case, the fundamental principles of Labour Law may play the key role. Their task is to form a bridge between the general (civil) and special part of Labour Law. Lze doložit případy, z minulosti i současnosti, kdy přes subsidiární působnost občanského zákoníku (občanského práva) nebylo možno uspokojivě řešit potřeby hospodářského života. A právě zde mohou zásadní roli sehrát základní zásady pracovního práva. Jejich úkolem je vytvořit jakousi převodní páku mezi obecnou občanskoprávní částí pracovního práva a jeho částí zvláštní.

The article deals with the interpretation of the heraldic decoration of the lower part of the eastern side of the Old Town Bridge Tower. The authors particularly consider arguments whether one of the coats of arms represents the Swidnica or Brandenburg eagle. Článek se věnuje interpretaci heraldické výzdoby spodní části východní strany Staroměstské mostecké věže. Autoři zejména zvažují argumenty, zda jeden ze znaků představuje svídnickou či braniborskou orlici.
